1. Introduction
(a) The Supplier specializes in jewelry and accessories, which can be purchased through the online store system at wal-market.com. Unless otherwise stated herein, these general terms and conditions apply to all products and services purchased by the Customer from the Supplier.
(b) For the purposes of these terms and conditions, the Customer is defined as an individual who deals with the Supplier for private and personal purposes only and shall not be involved in other commercial or freelance activities in which the Customer may be involved. For the purposes of these terms and conditions, a contractor is defined as any private person, corporate body or cooperation with a corporate entity that deals as part of its commercial or freelance activities.
(c) Any deviation, inconsistency or addition to any of the following terms and conditions shall render the contract null and void unless agreed upon in advance by the Seller and the Buyer.
(d) The right to modify these terms and conditions at any time by amending this page is reserved. The updated terms and conditions will supersede all previous versions of the terms and conditions.
(e) Use of this website (including accessing, browsing or registering to use this website) confirms unconditional agreement to be bound by these terms and to continue to abide by them.
2. Execution of Contract
(a) The Seller’s offer is subject to change at any time without prior notice and at the sole discretion of the Seller. While every effort has been made to ensure that the color, design and style of the products in the photographs displayed on the website represent the original products, changes may occur due to technical limitations of color reproduction on computer equipment. Therefore, in no event will wal-market.com be responsible for any errors or inaccuracies in the photographs or images of the Products displayed on the Site. (b) Confirmation of an order means that the buyer accepts the terms and conditions in their entirety. All orders can be made online on wal-market website. The transaction constitutes a binding agreement to enter into a contract for the purchase of the product. During the online ordering process on the wal-market website, by clicking on the “Send order” link, the customer issues a binding order for all products in the shopping basket. Orders cannot be modified or cancelled except as expressly provided in the Terms and Conditions
(c) Upon receipt of a fulfilled order, the customer will be notified by email. Please note: receipt of this first email does not mean that an agreement has been reached. The agreement is completed by sending an order confirmation or by the product being released.
(d) The release of the ordered products by the supplier for shipment also constitutes an acceptance of the order. Supplier reserves the right to reject an order without giving any reason.
(e) The reservation will be accepted at the end of the order in the event of incorrect or failed deliveries by the supplier, i.e. no products or only partial deliveries.
This applies only if the Supplier has entered into a specific hedging transaction and its subordinate suppliers have failed to deliver through no fault of their own. The Supplier will make all reasonable efforts to procure the Products. If the Products are not available for purchase, wal-market will immediately refund any payments that may have been received. The Customer will be notified immediately if the Products are not available or are only partially available.
(f) After the conclusion of the contract – if the Products are ordered electronically – the text of the contract together with the legally binding terms and conditions will be sent to the Customer by e-mail. The data registered on the website will serve as evidence of all transactions between wal-market and its customers. In the event of a dispute between wal-market and its customers regarding transactions on the website, the data registered by wal-market is considered irrefutable evidence of the transactions for that content.
